Recent developments reinforce the urgent need for general counsel and legal departments to deepen their focus on cybersecurity. In today’s environment, any organization can be the target of a cyberattack, regardless of industry, size, or geographic footprint. Indeed, in just the past few years, a variety of cyber adversaries have attacked financial institutions, social media sites, a movie studio, hospital systems, a peer-to-peer ridesharing company, the Democratic National Committee, hotel chains, city governments, educational institutions, telecommunications and energy utilities, prominent retailers, manufacturers, and even the mobile app of a well-known coffee and donut chain.

FCC Chairman Announces Intent to Stay Broadband Data Security Rules
The Federal Communications Commission’s Media Relations Office has released a statement announcing Chairman Pai’s intention to stay a data security rule adopted by the Commission late last year in its Broadband Privacy Order. Absent a stay, the rule is set to go into effect on March 2.
Making Sense of China’s New Privacy Laws and Draft Internet Privacy Regulations
Although China does not have an omnibus privacy statute or framework, the Chinese government recently has released a number of new privacy guidelines and regulations. This blog posts discusses a number of those guidelines and regulations, including two draft rules: Provisions on the Protection of the Personal Information of Telecommunications, and Internet Users and the Provisions on Registration of the True Identity Information of Phone Users (“Provisions on Phone Users”).

New Guidelines Released for Mobile App Privacy Policies
Amid increasing media and regulator scrutiny over location-based services, the Mobile Marketing Association has released a set of draft privacy policy guidelines for mobile applications (“apps”). These guidelines address key data privacy and security issues and provide a helpful “starting point” for companies that develop or deploy mobile apps.
