In the same week that the automotive industry gathers in Washington, D.C. for the 2018 Washington Auto Show, a cross-section of automotive stakeholders, government officials, and consumer and privacy advocates came together at Hogan Lovells’ Washington office to discuss privacy issues facing connected vehicles. The half-day conference, co-hosted by Hogan Lovells and the Future of Privacy Forum, convened on January 23, with the theme of “Privacy and the Connected Vehicle: Navigating the Road Ahead.” Panels focused on the privacy landscape surrounding automobiles and connectivity generally, regulatory developments and areas of government interest, and the effect of emerging technologies on business models and privacy practices in the automotive space. With lively discussion throughout and a wide array of perspectives, several key themes emerged.

The Federal Trade Commission and National Highway Traffic Safety Administration are co-hosting a workshop on June 28, 2017, to explore the privacy and security issues raised by automated and connected vehicle technologies. The agencies are looking to explore the types of data such technologies collect, store, transmit, and share; the potential benefits and challenges posed by the technologies; the privacy and security practices of vehicle manufacturers; the roles that federal agencies should play in regulating privacy and security issues; and how self-regulatory standards apply to connected vehicle privacy and security issues. In advance of the workshop, the FTC and NHTSA are seeking public comment on privacy and security issues. Comments may be submitted through April 20, 2017.

Connected vehicles today are rolling computers able to exchange information wirelessly with manufacturers, other vehicles, and third party service providers to significantly improve safety, efficiency, and comfort for drivers. Many entities are interested in the data these connected vehicles generate and transmit. These entities include dealers and repair shops, vehicle fleet service providers, end-users, infrastructure operators, diagnostics providers, researchers, financial services companies and insurance companies. The European Commission and industry actors in Europe, while recognizing the challenges of wide-spread deployment of these technologies, have taken further steps to develop a regime that facilitates information sharing for vehicle to vehicle, vehicle to infrastructure and other communications by delineating specific actions to take in the near future.

With attention to connected car cybersecuity issues increasing globally, the European Union Agency for Network and Information Security is leading the EU’s first bloc-wide initiative to identify cybersecurity rules of the road for connected cars. On July 13, ENISA announced a study aimed at creating a comprehensive list of cybersecurity policies, tools, standards, and measures to enhance security in next-generation automobiles.

Connected cars can generate large volumes of data, including data on engine performance, location, and driver behaviour. The European Commission has convened multi-stakeholder groups to figure out how to organize access to that data in a safe, competitively neutral, and privacy-friendly way. Two recent reports shed light on the principles under consideration for data sharing infrastructures in the EU. And legislative and regulatory developments in the EU will likely have a substantial impact on connected car deployments.
On 16 April 2015, the French data protection authority, the CNIL, published its annual report for 2014. The CNIL’s annual report is an opportunity for the authority to report on its activities over the previous year as well as set out its priorities for the coming year. Significantly, a number of new technologies such as connected cars and smart cities were included in the list of priorities that the CNIL will tackle in coming months.
The Alliance of Automobile Manufacturers and the Association of Global Automakers, the two leading trade associations for vehicle manufacturers, today unveiled a set of baseline protections for consumer’s personal information in the era of connected cars. The Privacy Principles for Vehicle Technologies and Services commit participating automakers to take important steps to protect the personal information retrieved from vehicles. Hogan Lovells was engaged by the Alliance to lead drafting of the Principles and a team led by Chris Wolf and including Tim Tobin and James Denvil worked on the project.
The Conference of the German Federal and State Data Protection Authorities during its last meeting on 8 and 9 October adopted the resolution “Data Protection in the Car”. The resolution expresses a concern about what it describes as privacy risks involved in the growing collection and processing of personal data in cars, and the interests of various actors (car manufacturers, service providers, insurance companies, employers) in using those data.
